Administrative sanction

In issuing the below order ie. G.O.Ms.No.18,Dated:26-03-2021, the Telangana government has empowred the Grmapanchats to work as independant and self government. The Garm Panchayats are empwered to accord Administrative saction unlimited amount and no need obtaion any kind of sanction from the out side authority, to take up developmental works.

In this regard it may be noted that as per sub-section(2) of Section 73 of Telangana Panchayat Raj Act, 2018, it is mandatory to the gram panchayat, that,the budget shall be sent to Mancda Panchayat Officer(erstwhile E.O.PR&RD) for scruitiny and suggestions.

But in the above orders, at para 1, grovernment has stated, that annual Budget be submitted, to the Divisional Panchayat Officer, for approval, which is contrary to Section mentioned above

Further it is also mentioned that the administration sanction accorded is subject to approval of Gram Sabha. In said section the buget so prepared by grampanchayats should have to be placed before Gram Sabha, for prioritization and aproval and it is mandatory to Grampanchayats to sanction the budget,as it is, without any modifactions to such budget. In case, the Gram Sabh doesn't approves the work taken up by the grampanchayat for any reason, what will the be fate of administrative sanction given by grampanchayat.

Read the following:
  1. G.O.Ms.No.91,Panchayat Raj & Rural Development (Estt.lll), Department, Dated:04.03.1999.
  2. From the CPR&RE, Hyd. Lr.No. DI/GPAD/17/2021, Dt.09.02.2021.

O R D E R :

In the G.O. 1st read above, orders were issued that the Major Gram Panchayats shall accord administrative sanction to Civil works upto Rs.2,00,000/- and Minor Gram Panchayats shall accord administrative sanction upto Rs.1,00,000/-. For Civil Works costing over and above Rs.1,00,000/- in Minor / Major Gram Panchayats, but upto Rs.3,00.000/- the administrative sanction shall be issued by the Divisional Panchayat Officer; and that over and above Rs.3,00,000/- administrative sanction shall be issued only by the District Collector. These powers applicable to all works under all grants. It is also ordered that all the Gram Panchayats should call for the Grama Sabhas, priorities the works and prepare annual budgets and submit them to the Divisional Panchayat Officers for approval. The Gram Panchayats should not take up works over and above the financial viability of respective Gram Panchayats.

The Commissioner, Panchayat Raj & Rural Employment, Hyderabad in the letter 2nd read above has stated that, as per the New Telangana Panchayat Raj Act, 2018, the Panchayats are empowered to spend the grants available with them, without reference to any other statutory authority and requested to issue necessary orders.

In the circumstances reported by the Commissioner, Panchayat Raj & Rural Employment, Hyderabad, in supersession to the orders issued in the G.O. 1st read above and after careful examination of the matter permission is hereby accorded as follows:-

  1. The Grama Panchayat is empowered to accord administrative sanction for works irrespective of the amount, subject to approval of Gram Sabha.
  2. The cumulative sum of Administrative sanction issued must be limited to the actual funds available during the current financial year.
  3. The execution, measurement and technical aspects of the works shall be as per the applicable norms of the Panchayat Raj Engineering Department.

The Commissioner, Panchayat Raj & Rural Development, Hyderabad is requested to take necessary action accordingly.

This order shall be applicable to each District with immediate effect, except Nalgonda District. This order shall be applicable to Nalgonda District after the completion of election in the District.
