Functional Committees in Grampanchayats of Andhrapradesh

ABSTRACT

FUNCTIONAL Committees -Constitution of Functional Committees in Gram Panchayats and Grama Janmabhoomi Abhivrudhi Samakhya (GJAS) under section 40 of Andhra Pradesh Panchayat Raj Act 1994 to strengthen the local bodies —Orders— Issued.

ORDER: -

The imperative of realization of the goals of Vision 2020 requires a continuous and periodic collective activity focusing on the key sectors. The Constitution enjoins the state to make appropriate provisions in the Panchayat Raj Act for devolving powers and functions on PR institutions in such a way as to enable them to function as institutions of self-government.

2.  The Gram Panchayats being grassroot democratic institutions are responsible for coordinated community action for all round development in rural areas. The Gram Panchayats are focal points for accelerating the pace of development by involving people in the planning process so that the needs of the citizens and their development aspirations are fulfilled.
3.  As a step in that direction the Government of Andhra Pradesh have decided to constitute the following five Functional Committees for every Gram Panchayat, in supersession of Functional Committees constituted in G.Os read above:
  1. Functional Committee for natural resources management (including Agriculture, horticulture, dairy, fisheries and water conservation.
  2. Functional Committee for human resources (Education, health, women and child welfare and all other related subjects).
  3. Functional Committee for employment generation and self-help groups.
  4. Functional Committee for finance and planning
  5. Functional Committee for works and infrastructure development.
4.  The aim of the above-mentioned functional committees is to make the Gram Panchayats responsible to evolve suitable programmes, mobilise and distribute resources, and oversee the implementation of the developmental programmes and strategies. The composition of each of the Functional committee will be as follows: -
  1. The Gram Panchayat Sarpanch shall be the Chairman of the Functional Committee. In the absence of Sarpanch the Upa Sarpanch will chair the functional committees meeting.
  2. Since the minimum number of ward members in a Gram Panchayat is seven (7) and the maximum twenty-one (21), at least one ward member and maximum of five ward members will be co-opted as members of the functional committee. Which ward member will be in which committee will be decided in a meeting of the Gram Panchayat. As far as possible all ward members will be equally divided among five committees. Panchayat Secretary will issue orders constituting functional committees in every grama panchayat based on the grama panchayat resolution.
    1. of the ward members co-opted for each committee, at least one should be from SC/ST/BCs/Woman category.
    2. No member of the Gram Panchayat other than Sarpanch shall be a member in more than one functional committee at a time.
    1. In such of those Gram Panchayats where there is only one MPTC member in a gram panchayat, the said MPTC member will automatically be co-opted as a member in all the five functional committees.
    2. In such grama panchayats where there are more than one MPTCs, the gram panchayat will decide which MPTC will be a member of which functional committee subject to the condition that no MPTC member can be a member of more than two functional committees.
    3. In such cases where there is only one MPTC for more than one grama panchayat, the said MPTC will be a member of all the functional committees of all such panchayats that he represents.
  3. Two leaders of women self-help groups active in the Gram Panchayat shall be coopted as members.
  4. Each functional committee will co-opt 2 persons having expertise in the subject. Spouses of Sarpanches, MPTCs and Ward members and their family members cannot be coopted as members in the guise of "experts".
  5. Cutting-edge level functionaries of all the line departments and agencies working at the Panchayat level like Anganwadi workers, MPHA(F), MPHA(M) , Mult purpose Extension Officer (MPEO) of agriculture department, Head Masters (HMS) of the local schools and any other functionaries can be co-opted as members by the village panchayat in such of those functional committees that require their services.
  6. The Chairpersons of the existing committees like NSS/School Education Committee/ Mothers Committee/VO/Watershed Committee/WUA etc., will automatically become members of the relevant functional committee. If the jurisdiction of the above said committee chairpersons extends to more than one grama panchayat, he becomes the member of functional committee of all GPs or he can nominate his representative who is a member of management committee/ Executive Committee of the said committee to become a member of that
  7. The Panchayat Secretary will be the member convener of each functional committee and record the proceedings of the said committees.

The co-opted of the members of the functional committee in the Gram Panchayat meeting shall be through a resolution of the Gram Panchayat.

The decision of the functional committees shall be subject to ratification by the Gram Sabha, which shall have the power to approve, modify, rescind and reverse them.

I.  Functional Committee for natural resources management (including agriculture, horticulture, dairy, fisheries and water conservation.)
  1. Take steps to conserve surface and ground water and prevent overflowing of useful water into drains.
  2. Manage water works and ensure that PWS schemes are hygienically maintained for the best use of Villages.
  3. Attend to Desilting of tanks.
  4. Undertake water conservation measures such as construction of check dams, percolation tanks wherever feasible.
  5. Keep a check on drilling of bore wells in consultation with ground water department to avoid depletion of ground water aquifers.
  6. See that drinking water storage tanks are cleaned regularly.
  7. Take up massive commercial plantation on community lands to augment local resources and prevent soil erosion.
  8. Judicious use of available natural resources like sand keeping in view the need for preserving sources of ground water percolation.
  9. Prevention of encroachment of tank bed land.
  10. Protection of the local flora and fauna.
  11. Protection of biodiversity and practice of kindness to animals.
  12. Protection of reserve forest through formation of Vana Samrakshana Samithis (VSS) and coordination with forest department.
  13. Protection and development of community land for pastures.
  14. Promotion of non-polluting industries and prevention and chemical contamination of community resources like revers, lakes and air.
  15. Establishment and maintenance of nurseries, stores of 'improved seeds'
  16. Conservation of manurial resources, preparation of compost
  17. Propagation of extension services for improved methods of Cultivation and preparation of action plans for Kharif and Rabi seasons.
II.  Functional Committee on human resources
  1. Propagate the importance of being literate and organize literacy classes/ drives.
  2. Ensure that all children in the age group of 5-14 are compulsorily enrolled in school.
  3. Educate people to prevent diseases by following protective health care programmes like immunization, personal hygiene, environmental sanitation, etc
  4. Spread the message of family welfare based on institutional delivery' child health care and small family norm.
  5. Organize village recreation programme and keep alive the folk art'
  6. Organize youth clubs, sports clubs etc.
  7. Encourage people's Cooperatives and self-help activities.
  8. Maintain village libraries/ reading rooms.
  9. Ensuring maximum participation of people, especially women and other weaker sections of the society in the welfare and development activities taken up in the village.
  10. Prevention of drug addiction and alcoholism.
  11. Creating legal awareness among women about their basic rights.
  12. Organization of health and medical camps.
  13. Capacity building of elected representatives, Self-help Groups (SHG) by organizing orientation programme
  14. Strive to abolish bonded labour/ Child Labour/Jogini/Devadasi system and other superstitious practices in villages.
  15. Promote the concept of self-help in all areas of life.
III.  Functional Committee for employment generation and self-help groups.
  1. Collection and processing of data relating to the unemployed and their employment needs.
  2. Maintaining lists of manual labour of the village.
  3. Create awareness in the people about the availability of wage employment/self-employment programmes/ schemes and identification of small enterprises and self-employment avenues that can be taken up by the youth.
  4. Organize training of the youth to inculcate marketable skills and develop entrepreneurial abilities.
  5. Arrange adoption of improved tool kits by the village artisans.
  6. Enforcement of minimum wages to the labour in the villages.
  7. Promotion of handicrafts and village cottage industries and organise marketing of the products of the village artisans at remunerative prices.
IV.  Functional Committee for Finance and Planning, ensure that all the tax and non-tax sources are comprehensively assessed, levied and collected.
  1. Prepare "Gram Panchayat vision document" assess the mobilization of local resources, dovetail the said resources with other government grants/ funds available under various government sponsored schemes and prepare annual as well as five-year Gram Panchayat Development Plans.
  2. All assigned revenues, grant in aid due to Gram Panchayat are got adjusted in time.
  3. Encourage people to participate in developmental activities by contributing in cash, kind or labour.
  4. See that the monthly/annual accounts and the budget of Gram Panchayat is prepared and submitted in time to Gram Panchayat/Gram Sabha and to the other higher authorities.
  5. Ensure that all the accounts and registers are maintained properly and kept updated.
  6. Arrange production of records to audit and see that audit is got completed in time.
  7. Take follow-up action on audit reports and see that final replies are sent to audit for settlement of audit objections.
  8. Allocate funds for various activities and place before Gram Sabha for approval.
  9. Proper supervision and monitoring of the various projects/works which are in progress in the Village.
V.  Functional Committee for works and infrastructure.
  1. Prepare Village data inventory on available physical infrastructure, natural resources and economic potential.
  2. List of the felt needs of the Village, viz, panchayat building, health centre, community hall, market complex, link roads, check dams, PWS scheme, etc., Prioritise the needs in Gram Sabha. Estimate the investment required and mobilise local resources/dovetail with the existing grants and revenue.
  3. Guiding the deliberations to identify and prioritise the needs of the people to fill the gaps in local development. Prepare feasible projects in consultation with technical personnel at the mandal and district level.
  4. Keeping in view the GP budget, prepare annual action plan for infrastructure development.
  5. Take steps for convergence all plans/schemes of different line department at GP level to avoid duplication, financial burden and delay in achieving desired results.
  6. Explore the possibility of involving in the village development the locally active NGOs, NRIs, and Trusts and seek their cooperation in Panchayat activities.
Janmabhoomi Abhivrudhi Samakhya (JBAS)

All the five functional committees referred to above will be coalesced to form the Janmabhoomi Abhivrudhi Samakhya which will look after the over-all planning, co-ordination and integration of the sectoral plans to form and approve the village vision document, five-year plan, and the annual plans. The JBAS will have the responsibility of periodic review as well as modification of the said plans depending on evolving situations from time to time.

COMMENTS

This Section provides for the constitution of not only the Functional Committees but also Beneficiary Committees exclusively for the execution of works of the Gram Panchayats. Constitution of Beneficiary Committees is also mandatory along with the Functional committees. Experience shows that only a few Gram Panchayats constituted functional committees under the repealed Act, but they seldom functioned. However, the provision relating to the formation of beneficiary as well as functional committees are useful, as it affords an opportunity to involve experienced and interested persons, who are not members of the gram panchayats in various developmental activities.
