Telangana Panchayat Raj Act,2018

The following Act of the Telangana Legislature received the assent of the Governor on the 29th March 2018 and the said assent is hereby published on the 30th March 2018 in the Telangana Gazette for general information.

[Act No.5 of 2018]

Act to provide for the Constitution or Gram Panchayats, Mandal Praja Parishads and Zilla Praja Parishads and for matters connected therewith or incidental thereto.

Be it enacted by the Legislature of the state of Telangana in the Sixty-ninth Year of the Republic of India as follows: -

Statement of Objects and Reasons: Telangana State has come to be formed on June 2, 2014 as 29th and youngest State in Union of India after long and heroic struggle of the people to fulfil their dreams and aspirations for development. The people of Telangana have demonstrated tremendous enthusiasm and commitment on programmes launched by the Government such as the Mana Vooru Mana Pranaalika and Gram Jyothi. The spirit and enthusiasm of the people and the elected representatives of panchayats can be harnessed to make the villages and the institutions more vibrant by bringing in their participation in the programmes implemented by the Government.

Panchayat Raj Institutions (PRIs) are the platforms for active participation of the people and play a key role in the implementation of various Central and State Government programmes. They are the grass root level institutions of governance meant for delivering essential and critical services having direct bearing on the quality of life and human development and there is a need to make these institutions strong and vibrant. The Government of Telangana have launched prestigious Grama Jyothi Programme to strengthen and empower the Gram Panchayats in the State and to make them more responsive to the needs of the people. It is the responsibility of Gram Panchayats to deliver the basic services effectively and efficiently.

Part IX of Constitution of India lays down the foundation for the strengthening of Panchayat Raj Institutions and Article 243G provides that the Legislature of a State may, by law, endow the Panchayats with such powers and authority as may be necessary to enable them to function as of self-government and such law may contain provisions for devolution of powers and responsibilities upon Panchayats at the appropriate level, and implementation of schemes for economic development and local governance.

It is of utmost importance to keep the villages clean and maintain hygienic environment to prevent diseases from affecting children and people and ensure their well being so that they lead a healthy and productive life. Maintenance of proper sanitation is the mandatory duty of the Gram Panchayats in the villages and it is necessary to make them discharge this duty effectively.

It is also important to restore the ecological balance in the State by way of improving the green cover in the State by taking up massive plantar activity To achieve this goal the Government of Telangana have launched Telanganaku Haritha Haaram programme and it is required to ensure the active participation of Gram Panchayats for its increasing the green cover.

There is also a need to make Gram Panchayats self-reliant and function effectively as grassroots tier of local self-Government by collection of all the taxes and non-taxes and mobilization of resources.

The State is growing rapidly and moving towards urbanization due to various policy measures initiated by the Government of Telangana and in order to ensure planned and balanced growth of the state there is a to regulate the settlement pattern and spatial growth with systematic development of layouts and construction of buildings.

Huge quantum of funds under Central Finance Commission and Government grants are being released to the Gram Panchayats for developmental activities. There is need to ensure that these funds are spent in cost effective transparent manner which can be achieved only through systematic planning which should be made mandatory for Panchayats.

It is also indispensable to bling in greater responsibility, transparency and accountability on part of Panchayat Raj functionaries for effective delivery of services through administration at village level with overall objective of improving the quality of life. The present law in State on the Panchayats does not contain sufficient provisions with regard to achieving the goals and objectives stated above and there is a need to improve the governance quality of Panchayat Raj institutions by redefining the roles and responsibilities of these Institutions and functionaries.

In the above circumstances, it is proposed to bring a new law governing the Panchayat Raj Institutions in the State with the aim of promoting and achieving these goals and objectives for by replacing the present Panchayat Raj Act, 1994.

This Bill seeks to achieve the above objectives.
